Limitation of Liability

Higher Powers Inc. shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our guided experience, whether based on contract, tort, strict liability, or any other legal theory, even if Higher Powers Inc. has been advised of the possibility of such damages. In no event shall Higher Powers Inc.’s total liability to you for all damages, losses, and causes of action (whether in contract, tort, including but not limited to negligence, or otherwise) exceed the amount paid by you for the guided experience..

Data Collection and Use

Higher Powers Inc. collects certain data from you when you participate in a guided experience. This data may include, but is not limited to, your name, email address, payment information, and any other information necessary to provide the experience. We use this data to provide and improve our experiences and software, and to communicate with you about our products and services.

By using our software and participating in our experience, you agree that we may collect, use, and share your data as described in this clause. We will not share your data with third parties except as necessary to provide our software and your experience. We may also use your data for research and analysis to improve our experiences and software, but we will do so in an aggregated and anonymized manner that does not personally identify you.

We take the security of your data seriously and have implemented technical, administrative, and physical measures to protect your data from unauthorized access, use, or disclosure. We will retain your data for as long as necessary to provide our service and software to you, or as required by applicable law.

User Responsibilities for Guided Psychedelic Experience

As a participant in this guided experience, you are responsible for the following:

1. Ensuring that you have provided accurate and complete information about your medical history, mental health, and use of medications, supplements, or other substances.

2. Following the guidance and instructions provided by the facilitators, including but not limited to instructions regarding dosing, administration, and set and setting.

3. Reporting any discomfort, distress, or unusual physical or mental sensations to the facilitators.

4. Refraining from using alcohol, drugs, or other substances during the session.

5. Abiding by all applicable laws, regulations, and ethical standards related to the use of psychedelic substances.

6. Maintaining confidentiality of any information or insights gained during the session, unless explicitly authorized to share such information.

7. Being responsible for your own physical and emotional well-being during and after the session, including seeking appropriate medical care if necessary.

By participating in this guided psychedelic experience, you acknowledge and accept these user responsibilities. You also understand that failure to abide by these responsibilities may result in termination of the session or other consequences as deemed appropriate by the facilitators.

Indemnification Clause

In consideration of participating in this guided psychedelic experience, you agree to indemnify and hold harmless Higher Powers Inc., the session facilitators, and their respective affiliates, agents, employees, and assigns, from and against any and all claims, liabilities, damages, expenses, and losses (including but not limited to attorneys' fees and costs) arising out of or in connection with your participation in the session, including but not limited to any claims for personal injury, emotional distress, or damage to property.

You acknowledge that the use of psychedelic substances carries certain inherent risks, and that despite the best efforts of the facilitator, such risks cannot be entirely eliminated. You agree to assume full responsibility for any harm or damage that may result from your participation in the session, except to the extent caused by the gross negligence or willful misconduct of the therapist or session facilitators.

You also agree to cooperate fully with the facilitator in the defense of any claim or suit that may arise in connection with your participation in the session, including but not limited to providing information and testimony as requested. You further agree to notify the facilitator and Higher Powers Inc. promptly in the event that you become aware of any potential claim or suit related to the session.

By participating in this guided experience, you acknowledge and accept this indemnification clause. You also understand that failure to abide by this clause may result in termination of the session or other consequences as deemed appropriate by the session facilitators.
